    Which authority for which dispute?

Before you consult, it helps to know who decides. Here are the competent authorities for the whole canton and the districts they serve, each with its official website.

    1. Tenancy

      Tenancy: the conciliation office

A tenancy dispute in Basel-Landschaft starts, in principle, before the Schlichtungsstelle für Mietangelegenheiten (tenancy conciliation office) – over a rent increase, service charges, defects or a notice to quit. It hears both sides and tries to settle the matter. If no agreement is reached, the case can go to the Zivilkreisgericht West or Ost, depending on where the flat is. Deadlines are short: have your request checked early.

    2. Work

      Employment: two district civil courts

In Basel-Landschaft, employment disputes go to the Zivilkreisgerichte. The Zivilkreisgericht Basel-Landschaft West covers the districts of Arlesheim and Laufen, the Zivilkreisgericht Basel-Landschaft Ost covers Liestal, Sissach and Waldenburg. If you live in the canton but work in Basel, the Arbeitsgericht Basel-Stadt may also be competent, depending on the case. A practitioner tells you where to sue.

      Family: the district civil court

Separation, divorce, custody and child maintenance are decided at first instance by the district civil court where you live – the Zivilkreisgericht Basel-Landschaft West for the lower part of the canton and the Laufen valley, the Zivilkreisgericht Basel-Landschaft Ost for the upper part. A first consultation clarifies your options, the documents you need and the chances of an agreement before any proceedings begin.

Criminal law: one criminal court for the whole canton

Criminal investigations are led by the Staatsanwaltschaft Basel-Landschaft (public prosecutor). If charges are brought, the Strafgericht Basel-Landschaft (criminal court) tries the case for every district. You can object to a summary penalty order – the deadline is short. You may bring a lawyer to every interview; a criminal lawyer explains your rights and prepares the interview with you.

If you cannot afford proceedings and your case is not without prospects, you can apply for legal aid. The application goes to the court where the case is pending or is to be brought – in civil proceedings, usually the district civil court. Legal aid can waive court costs and include a court-appointed representative.

    See all questions
How do I find a verified lawyer in the canton of Basel-Landschaft?

On ora., every lawyer is checked against a cantonal bar register, and every legal adviser proves a Swiss law degree. You filter by area of law, language and place, from Liestal and Sissach to Allschwil and Laufen, and compare profiles and fees. You book online, at the law firm or by video.

Which Zivilkreisgericht is competent for my municipality?

It depends on the district. The Zivilkreisgericht Basel-Landschaft West covers the districts of Arlesheim and Laufen – for example Allschwil, Binningen, Reinach, Muttenz or Laufen. The Zivilkreisgericht Basel-Landschaft Ost covers the districts of Liestal, Sissach and Waldenburg – for example Liestal, Pratteln or Sissach. Criminal cases for the whole canton go to the Strafgericht Basel-Landschaft.

How much does a lawyer cost in the canton of Basel-Landschaft?

Every lawyer and legal adviser sets their own fee; it depends on the area of law, the work involved and their experience. You can see the fees of practitioners advising in the canton of Basel-Landschaft live on this page and in each profile before you book. ora.’s service fee is shown on a separate line and is never added into the practitioner’s fee.

How do I challenge an administrative decision in the canton of Basel-Landschaft?

Against a decision of a cantonal or municipal authority – a building permit or a decision of the municipality, for example – an appeal to the cantonal government or another internal authority is often available first. After that, an appeal usually goes to the Kantonsgericht Basel-Landschaft, Abteilung Verfassungs- und Verwaltungsrecht (constitutional and administrative law division of the cantonal court). The deadline and the remedy are stated at the end of the decision. An administrative lawyer checks which route applies in your case and whether the deadline is still running.

What does the Basellandschaftlicher Anwaltsverband do?

The Basellandschaftlicher Anwaltsverband is the professional association of lawyers in Basel-Landschaft. Membership is not the same as being entered in the cantonal bar register, which entitles a lawyer to represent clients in court. ora. checks that register entry before a lawyer’s profile is published.
